data-contrast=\"none\">AIFMD 2<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">While AIFMD 2 entered into force on 15 April 2024, the fast-approaching 16 April 2026 is when\u00a0all EU member states must have transposed the Directive into national law.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As a leading\u00a0jurisdiction\u00a0for\u00a0alternative investment\u00a0funds,\u00a0<\/span><a href=\"https:\/\/iqeq.com\/je\"><span data-contrast=\"none\">Jersey<\/span><\/a><span data-contrast=\"auto\">\u00a0keeps a close eye on relevant regulatory changes in the\u00a0UK and Europe, including AIFMD 2.\u00a0\u00a0Although Jersey is a third country, it relies on alignment with EU and UK AIFMD regimes to\u00a0maintain\u00a0market access for Jersey-domiciled funds through national private placement regimes (NPPRs).\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A review of the\u00a0AIFMD 2\u00a0amendments has been made against Jersey\u2019s\u00a0current\u00a0regulations and relevant legislation for\u00a0alternative investment funds (AIFs)\u00a0and\u00a0<\/span><a href=\"https:\/\/iqeq.com\/services\/aifm-services-depositary-services\/\"><span data-contrast=\"none\">alternative investment fund managers (AIFMs)<\/span><\/a><span data-contrast=\"auto\">.\u00a0The revised Directive\u00a0mainly increases\u00a0regulatory standards for EU AIFMs and EU AIFs, but some changes impact non-EU (e.g.\u00a0Jersey) managers who market into data-contrast=\"auto\">AIFMD\u00a02\u00a0strengthens EU AIFMs\u2019 delegation oversight, but these changes do not\u00a0affect\u00a0Jersey AIFMs under Jersey\u2019s AIF Code.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h3>Depositary\u00a0regime \u2013\u00a0not\u00a0applicable to Jersey\u00a0funds<\/h3>\n<p><span data-contrast=\"auto\">AIFMD\u00a02\u00a0introduces new conditions enabling EU funds to appoint depositaries outside their home state.<\/span><span in June 2025\u00a0on similar provisions\u00a0and will be issuing\u00a0their\u00a0draft rules implementing the UK AIFM proposals in the first half of next year, under consultation.\u00a0Once these changes are known,\u00a0going forward the\u00a0Jersey\u00a0AIF Code\u00a0will\u00a0effectively\u00a0be split into two parts, one for EU AIFMD and the other for UK AIFM.<\/span><span
